AN ORDINANCE TO REGULATE THE USE OF TOWN ROADS FOR LOGGING OPERATIONS
REGULATION OF USE OF TOWN ROADS FOR LOGGING OPERATIONS ESTABLISHED
Pursuant to RSA 41:11 and RSA 47:17 the Selectmen of the Town of Sutton hereby establish the following regulations for the use of town roads for logging operations.
PERMIT REQUIRED
A permit is required for the use of town roads in conjunction with logging activities. Any individual required to file a Notice of Intent to Cut pursuant to RSA 79:10 is required to obtain a Road Use permit from the Office of the Selectmen.
The application shall include a map depicting the property to be logged and showing the log landing site and direction of travel over town roads.
The application shall include a list of abutters and a certification that the applicant has both notified all abutters of the proposed logging activity and obtained permission from the owners of land over which the applicant will traverse during the logging activities.
The application shall include proof of the applicant’s current certificate of liability insurance.
LANDINGS AND SKIDDING PROHIBITED
No person shall use or cause to be used any portion of a town road for the purpose of a “landing” or for “skidding” in conjunction with logging activities.
4. PENALTY
Any person who violates any provision of this Ordinance shall be subject to a penalty in the amount of $300.00 for a first violation, $500.00 for a second violation, and $1,000.00 for a third violation. Such person shall be deemed to have committed a separate violation for each and every day during any portion of which any violation of this Ordinance is committed, continued or permitted by such person.
REPEAL
All prior ordinances inconsistent herewith are hereby repealed.
