ROAD WEIGHT LIMIT ORDINANCE
WEIGHT LIMITS ESTABLISHED
Pursuant to RSA 41:11 and RSA 231:191 the Board of Selectmen of the Town of Sutton, upon recommendation of the Town Road Agent that such postings are required to prevent unreasonable damage or extraordinary municipal maintenance expenses as a result of the intensification of logging, excavation, construction and other activities involving heavy vehicles, hereby establish the following weight limits for the following town roadways:

Any town road or bridge subject to a weight limit may be posted at any time of the year that the Board of Selectmen and/or the Road Agent deems necessary.
The Selectmen reserve the right to temporarily add roads to those listed in paragraph 1,A., or amend the stated weight limits without amendment of this ordinance, when it is deemed necessary to do so to prevent unreasonable damage or extraordinary municipal maintenance expense. Such temporary changes shall be effective for 30 days.
NOTICE TO BE POSTED
Notice of these weight limits shall be posted at the entrances of all restricted roads. Such signage shall be legible, posted in a conspicuous location, and be of weather resistant materials.
EXEMPTIONS
The Board of Selectmen reserve the right to grant exemptions from the above weight limits for limited times and purposes upon specific application. Any person seeking such an exemption shall apply to the Selectmen or the Road Agent upon such form as the Selectmen or the Road Agent prescribe and such permit may be issued if in the opinion of the Selectmen or the Road Agent, the issuance of the permit will not be detrimental to the preservation of the Town roads nor detrimental to public safety. In issuing such permit, the Selectmen or the Road Agent may attach such conditions as they deem to be in the best interests of the public including but not limited to the establishment of bonding and restoration requirements.
In addition to the exemption provisions stated above, the Board of Selectmen may exempt some or all of the following categories of vehicles from the operation of this Ordinance: Town Highway Department vehicles, Fire Department vehicles, emergency vehicles while going to and from the scene of an emergency, commercial solid waste disposal vehicles, oil or gas delivery vehicles, postal vehicles, and school buses.
PENALTY
Any person who violates any provision of this Ordinance shall be guilty of a violation if a natural person, or guilty of a misdemeanor if any other person and in addition, shall be liable for the cost of restoration of the highway to a condition satisfactory to the Board of Selectmen or its designee.
REPEAL
All prior ordinances inconsistent herewith are hereby repealed.
