March 17, 2009 Minutes

The meeting was called order at 7:04 p.m. by David Burnham, Acting Director.  In attendance were Robert Wright, Jr.; Carrie Thomas; Paul Raynor, who was sitting in for Courtney Galluzzo, and Peter Blakeman who arrived approximately at 7:13 p.m.

Motion made by Robert Wright, Jr., and seconded by Paul Raynor to accept the meeting minutes from December 23, 2008, January 27, 2009, February 10, 2009 and February 24, 2009 as submitted.  Unanimous vote.

Members agreed to waive the correspondence until the next meeting.

Case #1 – Continued Hearing for Crown Castle/Omnipoint Communications, King Hill/Summit Road, Cell Tower Addition.  Michael Johnson from Crown Castle/Omnipoint Communications was in attendance.  He was asked if he had any more information for the record.  He explained that Crown Castle and the King Ridge Homeowner’s Association had come to a tentative agreement.  There may be another possible route for winter maintenance off of Hominy Pot Road which is being looked at.  He also stated that there will be signs placed for parking of vehicles.  Nick Signorelli, 180 Summit Road indicated that all parties where in agreement but there was nothing on paper to date.  There was some discussion regarding the height from David Brazier.  Board members confirmed that the addition will not change the height that already exists.

Robert Wright, Jr., made a motion to close the public hearing.  Paul Raynor seconded.  Unanimous vote.  Robert Wright, Jr., made a motion to approve the Crown Castle/Omnipoint communication addition with the condition that the written agreement between Crown Castle/Omnipoint Communications and the King Ridge Homeowners Association be acceptable to both parties and, the Planning Board be duly notified.  Paul Raynor seconded.  Unanimous vote.

Case #2 - Priscilla & Alan West, Grist Mill Condominium,        Grist Mill Road, Map #6, Lot #416,245, Minor Subdivision, Condominium Conversion.  In attendance were Matt Landry from Eric C. Mitchell & Associates, Inc. and Priscilla West, owner.  Also in attendance were Chris Rowe, Fire Chief and Pamela Theis and Jodi Garside, Abutters.  The application was accepted as complete.  Peter Blakeman made a motion to accept the waiver as submitted with the application.  Paul Raynor seconded.  Unanimous vote.

Primary discussion of this application centered around the parking for each “unit”.  As there is no designation for spaces for the “apartments” currently, board members requested that parking for each “unit” be defined on the future plan.  Also discussed was the “LCA” which is the limited common areas on the plan.  Right now the “property” consists of two buildings.  1 building is a detached rental unit.  The second building has 3 floors with the 1st floor being a wholesale natural herb lotion, etc. business; the 2nd floor consists of two apartments with the 3rd floor containing the second floor of the 1st apartment on the second floor.

Robert Wright, Jr., read from RSA 672:14 – Definition -  “Subdivision'' means the division of the lot, tract, or parcel of land into 2 or more lots, plats, sites, or other divisions of land for the purpose, whether immediate or future, of sale, rent, lease, condominium conveyance or building development.

As the building exists now, there are 4 rental units in two buildings with one owner.  With the change it will be 2 buildings with 4 owners, 1 for each unit.

Carrie Thomas referred back to an e-mail from Town Counsel to the Land Use Coordinator regarding the change in use and how this would fall within the law.  Peter Blakeman would like to get further Town Counsel input as, to date; the Town of Sutton has no regulations in place for Condominiums and how does this affect the change in use of the current building regulations and what type of upgrades this could lead to.

Chris Rowe, Fire Chief is concerned with the parking issue as there have been previous fire related calls to this property in recent years.  This property has limited parking on the right hand side and it was difficult to park and maneuver the fire hoses to a previous fire.  He would also like to see updated fire egresses per fire code.

Jodie Garside and Pamela Theis were given an explanation as to why they received abutter letters for tonight’s hearing.  Ms. Garside also had questions regarding the parking for each unit as well as parking on the left hand side of the building.  Ms. Theis questioned the number of parking spaces allowed for each unit.

The following information is needed for the members to proceed with this application:

        Condominium documents.
        Prior Zoning Board of Adjustment records.
        Any prior approvals the current owner has on file i.e, Fire Marshall, etc.
        Any condominium plans that will get recorded.
        Town Counsel input regarding fire code, common areas and parking issue.
        Defined parking areas for each unit on the plans.
        Define common areas to be used by each unit.

Robert Wright, Jr., made a motion to continue this hearing to April 14, 2009 at 7:00 p.m.  Peter Blakeman seconded.  Unanimous vote.
